RUMOR CONTROL: FORECLOSURE NOTICE INVOLVING ICE CREAM FACTORY

LEBANON, Mo. — A foreclosure notice published in Wednesday’s newspaper involving ICF Holdings LLC has raised questions about whether the Ice Cream Factory building in Lebanon is being foreclosed on.

The City-owned Ice Cream Factory building is not part of this foreclosure.

The notice names ICF Holdings LLC and Shannon Imler and announces a trustee’s sale scheduled for Oct. 26, 2026, at 1 p.m. at the front door of the Laclede County Courthouse.

According to the notice, the foreclosure involves property securing debts associated with ICF Holdings LLC. It contains lengthy legal descriptions of multiple tracts and identifies the property with an address of 1201 Kansas Street, Lebanon, Missouri.

That address can understandably create some confusion.

City documents from the original Ice Cream Factory development identify the project as an approximately 12-acre site at 1201 Kansas Street, including land, buildings, structures, fixtures and equipment associated with the project.

However, the City of Lebanon currently owns the Ice Cream Factory building at 1201 Ice Cream Way.

The City confirmed that ownership in a statement released Sept. 23 while addressing questions surrounding its financial involvement with the company. According to the City, the electrical improvements made earlier this year were made to a building already owned by the City.

The City specifically stated that it “already owns the building at 1201 Ice Cream Way and keeps it either way.”

The foreclosure notice published Wednesday concerns property interests securing debts of ICF Holdings LLC. The notice references several promissory notes and deeds of trust and provides specific legal descriptions for the property subject to the trustee’s sale.

To be clear: The foreclosure notice does not mean the City of Lebanon is losing the Ice Cream Factory building. The City-owned building at 1201 Ice Cream Way is not being foreclosed upon through this notice.

The foreclosure comes amid other questions surrounding the Ice Cream Factory. Lebanon Now has previously reported allegations from former employees who said they experienced missing or delayed paychecks, depleted savings and weeks of uncertainty.

The City has acknowledged those reports but said Sept. 23 that it had not independently verified the employee-pay claims and that those matters fall outside what the City oversees.

Lebanon Now will continue reviewing the foreclosure and property records as additional information becomes available.
